    My website – www.conjugalfelicity.com – was disabled today by my hosting service. Apparently they (and I) are getting sued by Sylvia Scott Gibson, author of the Latawnya the Naughty Horse books.

    For copyright infringement.

    This is going to be interesting.

    That’s a link to a copy of the lawsuit that Gibson recently filed against Amazon.com, Wikipedia, and Urban Dictionary. Filed it pro se (meaning she doesn’t have a lawyer and is representing herself). The lawsuit itself is full of typos and grammatical errors.

    Apparently she thinks that an article on Wikipedia is copyright infringement. And that people shouldn’t be allowed to resell her used books on Amazon.com.

    Wouldn’t this all fall under fair use as a parody/critique? Unless you were quoting/posting images of significant parts of the book, I don’t see how it would count. That’s why we’ve got fair use copyright laws, after all, to protect people who want to critique/parody things.

    I, too, thought that the Tesch Legal Machine TM was after you. It sounds like Gibson either has no idea what “fair use” means, or she’s one of those people who figures that any attention she can drum up = good attention. Getting sued sucks, but I wager you’ve got a good case. Good luck!

    Litigation (i.e. the Gibsons are fucking insane) is still ongoing. The judge should actually be ruling on Monday the 22nd on a motion for summary judgment (i.e. to dismiss the case). We’ll see how it goes.

    I’m not being sued anymore!

    The case was dismissed, as I discovered today, at long, long, long last. Actually, it was dismissed nearly a month ago. I found out today because the case had essentially been sitting in limbo for the past six months and was at the point where I’d practically forgotten about it (waiting to see if the Gibsons would continue pursuing the matter).

    So. That’s pretty sweet. And now I need to actually write up a few obscenely long articles about the lawsuit and the general hilarity that went along with it.

    I’ll be detailing this in full later on, but what it boils down to is they have no idea how search engines work.

    Essentially, they were suing a website because if you Googled “latawnya the naughty horse learns to say no to drugs pornography” it brought up a porn website that also had a messageboard where people were talking about the Latawnya the Naughty Horse book. Hence, entering her family into pornography – since the characters of the horses are her family’s names.

    I’d prefer Zach to Maquisher or something similar. Zach is the shortened form of Zachary which is a form of Zachariah, meaning God Remembers. Most of these new names are either a combination of two names or they don’t mean anything at all. So while you sacrifice a little on the originality, at least you name some depth to the name.

    This is coming from a person who constantly has people in her class with the same name, and who’s still happier with it than one that no one can pronounce without asking me.

    Names are almost never chosen for their meaning so that’s a pretty irrelevant thing to bring up. People name their kids Zach because other people named their kids Zach and they think it sounds good. I have 3 friends named Zach. Do you think their parents had ‘god’ in mind when they named them? (I’ll give you a hint- they didn’t)

    I personally think Oswald and Thaddeus are stupid names and they both have meanings. What difference does that make? It doesn’t make them sound any less awkward. But I’d still rather be named Thaddeus than Dave or Zach.

    edit: if I sound bitter it’s because I too have a generic name. Probably one of the most generic names possible for a white guy

    Not necessarily. Most people I knew actually do choose based on the meaning. That’s where mine and my sister’s came in, as well as most of my friends.

    And yeah, there are plenty of people in the world who just might have God in mind with a name. I know a guy named Theodore. He was named that because it meant ‘gift of God’ and they hadn’t thought that they were going to have a kid. Not because of Teddy Roosevelt or the chipmunk.

    It does actually happen. Even today.

    Also, I’ve never actually met a Zach. Met way, way, way, too many people with names I had to see spelled out before I could properly say them though. While I’ll give that sound has a definite influence (hence not many Oswalds lately) but I think that meaning really does have a point. Hence why I prefer my name to something like Lucinda which was just flat made up by the guy who wrote Don Quixote.

    Also, you neglect to note that people also name their children for family.

    I was thinking of some people I know (white) who think they they were being ‘original’ by making up names for their kids. They have this seriously pretentious attitude towards everyone around them for it too. It just sets my teeth on edge.

    And Sues. I’ve been reading about why too many Sue names lately. I’d like a character named Amy or Mary or Rachel in one of these books. It would be rather nice for a change.

    (Ironic for someone’s whose screen name is somewhat unpronounceable.)

    Edit@Nossus: I did wonder. I guess I’ve just kind of accepted it and developed a kind of liking for my name.

    As someone who has a unique name (you can find me just by Googling my first name, which is why I don’t give it out), there are times I seriously wish I had a common one. People always tell me I have a lovely name, but such compliments fall short when said people cannot correctly pronounce said name. My name is not Chillin. Or Chinchilla. And I am most definitely NOT Chow Mein, especially not if you’re shouting it in a crowded room.

    And don’t get me started on the… interesting attempts at spelling. Like Showlin. Which I think might have been an attempt at spelling Shaolin. And Killin.

    And the saddest thing is, I’ve given up on correcting people. There’s too many of them. @_x

    This is a trap that Anti-Shurtugal fell into. Yeah, you think that a particular author isn’t good at their job therefore everything about them is deserving of ridicule to the point of absurdity.     Eh, I’ve lived in places where the weirdest names were given to white girls. I knew one girl in high school named Polly Esther Slack, and another named Candle Light. My sister had a friend named Celestial, and one of our neighbors was named Brittany, but she changed it to Ocean. The black girls at my school had names like Ashley and Brittany.

    In NZ a while ago someone named their kid “Tallula does the Hula from Hawaii”. The registry that handles that sort of thing rejected it, though. From an article on it:

    Oh, that poor kid. Isn’t that somewhat abusive?

    This has been bugging me for a while. How does one pronounce “Pryotra” exactly?

    Well, I kind of mentally pronounce it Per-yo-tra (despite the fact that I’d need another vowel for that to really work) but other people on ff.net who give me the nickname ‘Pry’ obviously pronounce it Pree-o-tra or Pry(as in cry)-o-tra. So…there’s no actual way to do it.

    As for what it means, I mentioned the story on my intro thread. Suffice it to say that it’s something of a hybrid of an another name with some joke aspects joined in.

    Moving the conversation back on topic, or somewhat on topic, if I were this woman’s kid, I might be somewhat offended that she based her ‘naughty horse’ on me. This isn’t the first time that I’ve seen people do this. I mean, it’s pretty obvious that SMeyer pretty much hates her family, but I’m always surprised when they get surprised when people both use the names of the characters and talk about them.

    Then again, we’re talking about a person who tried to sue wiki and Amazon.

    I would say PrittOhRuh or PrittUhRuh or PrittAhRah, all pronounced as a dactyl. Another dactyl might be PriTuhRuh, with the T part of the second syllable instead of the end of the first, but whether the T sound becomes part of the second syllable is dependent on the second vowel sound you use.

    I have a habit of stressing the trochaic syllables (1,3, etc), so I say PRY-oh-TRA. Because of linguistic issues, up until this thread I read it PRY-oh-TRY-ah.
