Sept 1, 2007
Today was my first day at my new school. Not only was I too shy to talk to anyone, it rained all day. Charlie, my dad, says that I better get used to it because it rains here a lot. Well, there’s no use whining about it. I’ll just have to make the best of being here.
I’ll try and be positive. Two good thing that happened today:
1. I reconnected with Jacob Black. It’s been so long since I’ve seen him. He’s taller than me, now. Who would have thought he’d have gotten that cute when he grew up? He’s dropping by this afternoon to show me around Forks. Not that there’s anything to see, but it’s nice of him.
2. I feel stupid saying this, but there’s this REALLY hot guy in my class. I can’t even describe him! He seemed to notice me too, even though I’m rather plain. I wonder if I’ll ever have the courage to talk to him or even find out his name. I didn’t even pay attention in class because I was too busy staring at him.
Strangely, I didn’t spot him in the cafeteria at lunch. He came back to class about a half-hour late, looking kind of sleepy. I kind of had to wonder where he went. I wanted to stop him in the hallway after school and ask, but my courage failed me. Oh well. I’m going to have to live here awhile, so I’ll eventually be brave enough.
Oops, Jacob’s here. I have to stop writing now. (Note to self: e-mail Mom so she doesn’t freak out)
It is now about two AM, but I couldn’t sleep. Every time I close my eyes, I see that boy’s face. I really don’t know what my problem is, I’ve never obsessed over a boy before. Unless it was a fictional one. Like Romeo. Only I hope this guy is a little less stupid and wouldn’t commit suicide over a girl. Well, I’m going to try and get some sleep now so I can focus on school tomorrow.
Sept. 2, 2007
I nearly fell asleep today, but staring at him kept me awake. His name is Edward, I found out. I heard two girls whispering about him. They seem as taken with him as I am. I’ve never seen him talking to them, but he sure spends a lot of time staring at them. Maybe he’s shy, like me.
I asked Jacob if he knew anything, and he was really weird. The conversation went like this:
Me: “What can you tell me about Edward Cullen?”
Jacob: “I would stay away from him if I were you.”
Me: “Why?”
Jacob: “I’ve heard bad things about him.”
Me: “What kind of bad things? From who?”
Jacob: “I’m not sure, exactly. My father has some sort of grudge against the entire family. Just…be careful.” And he held my hand while we walked down the hallway. I thought it was cute, but Edward looked angry. I wasn’t going to talk to him with Jacob there. I’ll have to wait until Jacob is out sick or something.
It rained again, today. Yuck.
Sept. 3, 2007
More rain. I failed a test because Edward was staring at me. Just looking into his eyes froze my brain. I expected him to talk to me after staring at me for so long, but he disappeared at break, and by the time he got back, Jacob was with me, so he didn’t come near.
It’s raining really hard now. I wish I could just stay here with my journal and mug of coffee, but I need to go make supper because Charlie isn’t home and I don’t want to starve.
Charlie came home while I was eating and expected me to share with him. I don’t eat much, so I cut him a bit of steak. He seems really tired. He told me that a lot of people had been going missing lately, mostly girls. He said, in these exact words:
“Don’t ever go out alone. Don’t give anyone our address or telephone.”
Of course, I said that I wasn’t four and could take care of myself.
Him: “Bella, I know you’re capable. Just…be careful, is all.”
Me: “I’ll be fine, Dad. Really. Besides, I’m too plain to be stalked.”
He shrugged and said that he thought I was very pretty. He’s such a sap.
Does he really think that I’ll get kidnapped? I’m too smart for that. He shouldn’t worry so much, he’s got enough to worry about without me. Still, I’ll be careful for his sake.

It’s Saturday, so I won’t see Edward today. It nearly scares me how much I hate that thought. He fills my every waking thought, and whenever he’s near, my heart beats so much faster. I feel like one of those shallow, giggly girls who go shopping and talk about what movie stars they love. That usually makes me ill, but I guess I understand it now.
A few of them invited me to go shopping today, and I guess I will. Maybe if I pick up something nice, Edward will pay attention. Not that he doesn’t, but maybe he’ll talk to me. I know that Charlie wouldn’t like me dressing up to attract a guy. He’d say it wasn’t safe. Which is why I won’t say anything to him.
Besides, tonight Jacob is taking me out for hamburgers. I should make some effort to look presentable for him. He’s cute, but he’s no Edward Cullen.
The girls are here. I’ll write more later.
Oooh…it looks like Eddie’s mind powers are affecting Bella already. Amazing what they can do when there’s actually a mind to work with.
This is interesting. So much more well written than Twilight, more realistic, I can stomach Bella as a character….it’s just BETTER.
The wild theory that Bella was a mental patient in love with a statue at the asylum was always one of my favorites.
Yes, Nate, but I doubt that this story will have robots or ninjas.
Anyway, I like the journal entry style. Reminds me of Dracula.
I’m starting to think we should start consolidating all of our Twilight rewrites around here.
I happen to be firmly against the idea of a sincere rewrite. Poorly-written, badly-devised and shallowly and illogically constructed some books may be, copyright is still copyright, and the idea of a genuine attempt at ‘rewriting’ something is technically illegal. However, I already made my views known over at AS when the plans began for a concerted group-effort at rewriting Eragon were announced… “But no, they wouldn’t listen. Question: What is fair use and how does it relate to Fan Fiction?
Answer: The fair use doctrine says that otherwise copyrighted works may be used for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. To decide whether a use is “fair use” or not, courts consider:
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
Parody is also fair use.
Under this doctrine, artists have been permitted to create and display their art even if it uses copyrighted works of others. See Court Allows Artist to Sell Barbie Art, for an example.
There is a strong argument that many fan fiction stories are transformative since they create a different persona and set of events for the character. To create a new story cannot be seen as the same as posting video clips on a website. There must be a balancing between protecting copyrights in order to encourage innovation by authors and between allowing works to be in the public domain to allow creative uses.
Whether a court will view this as the case for a particular work of fan fiction depends on how much of the story relies on copyrighted materials, whether the story is sold, or affects the market for the copyrighted work, and other factors. There is no easy answer to the question, which is why it is often a good idea to consult a lawyer who can assess the particular facts of your case.
Satire/parody is indeed covered under fair use- the idea, according to the cases I’ve read about, was to protect the right of people to mock things they dislike, so no one could ever be like “You can’t make fun of <whatever>!” and then we’d have the right to disagree with the government/Wal-mart/your mom out the window. Satire is specifically protected under fair use copyright laws, if you read the actual laws, so while the Poker Face music video on Youtube isn’t necessarily protected, a remix version of Caramelldansen with House clips in the background is.
